Information notice for the processing of personal data in connection with the use of the Zesumme Vereinfachen platform
Who is responsible for processing your data?
The Ministry for Digitalisation (4, rue de la Congrégation; L-1352 Luxembourg; tel. +352 247-72100), hereafter the Ministry, acting in its capacity as data controller for the processing of personal data in connection with the use of the Zesumme Vereinfachen platform, collects and processes personal data about you ("data").
What categories of data are processed and what is the basis for the lawfulness of the data processing?
On the basis of your consent (Article 6(1)(a) of Regulation (EU) 2016/679), the Ministry processes the data which:
- you provide during the registration process on the Zesumme Vereinfachen platform, namely (i) compulsorily, in order to be able to access the platform, your first and last name, your e-mail address, and your password, and (ii), optionally, your language, the capacity in which you want to contribute (private individual, public official or professional) and your country of residence ("user profile");
- you provide in the context of your use of the platform as well as any action which you perform on the platform, such as your votes, ideas, comments, answers to questionnaires and queries, etc. ("your contributions to the platform"). Please note that if you wish to share your contributions to the platform with us, you must provide these data (which are linked to your user profile) to the Ministry.
- In addition, the Ministry collects "technical" data by means of cookies, such as your IP address and browser references, and processes them in accordance with Article 6(1)(f) of Regulation (EU) 2016/679 in order to ensure the proper functioning of the platform. What are the purposes of the data processing?
Your data is processed for the following purposes:
- to identify and analyse your contributions to the platform and their context, and to produce reports based on all the data collected on the platform in order to assist the Luxembourg Government, in particular in the context of simplifying administrative procedures;
- to ensure communication between users and/or with the Ministry;
- to create and maintain your user profile;
- to manage the identification and authentication of users of the platform;
- to provide information about your community and/or alert you to activities on the platform which may be of interest to you. You may unsubscribe from emails from the platform at any time;
- to monitor the proper functioning of the platform;
- to compile statistics, in particular on the use of the platform.
Who are the recipients of your data and how long are the data kept?
The Ministry, in collaboration with the subcontractors acting on its behalf (in particular the company Go Vocal NV, located at Pachecolaan 34, 1000 Brussels, Belgium), processes the data:
- concerning your user profile, in a form that allows you to be identified, until thirty days after your decision to delete your user profile, or in case of longer inactivity on your part on the platform, twelve months after your last connection to your user account;
- concerning your contributions to the platform, in a form that allows you to be publicly identified via your user account, for up to three months following the conclusion of the project.
At the end of these periods, your data will be rendered anonymous and processed by the Ministry and its subcontractors for statistical purposes (e.g. usage statistics), scientific research and improving the platform.
The above storage periods apply without prejudice to the processing of your data for the purpose of establishing, exercising or defending a legal claim, and to the possible further processing of your contributions to the platform for archival purposes in the public interest (in particular, their transfer to the National Archives in accordance with the provisions of the Law of 17 August 2018 on archiving).
Without prejudice to the transfer of your data to the National Archives, your data will not be shared with third parties in a form that allows you to be identified.
Where will your data be processed?
Your data will be processed exclusively within the European Economic Area (EEA) and will not be transferred internationally within the meaning of Chapter V of Regulation (EU) 2016/679.
What are your rights?
You have the rights provided for in the provisions of Chapter III (Articles 12 to 22) of Regulation (EU) 2016/679.
You may thus, within the limits of the applicable legislation, access the data concerning you, request information about the use made of your data by the Ministry and obtain a copy of them (Article 15). You may also request the rectification of inaccurate or incomplete data (Article 16) and the erasure of personal data in accordance with Article 17 of the Regulation. In certain cases, you also have the right to limit the processing of your data (Article 18) and to the portability of the data you have provided to another data controller in a structured, commonly used and machine-readable format (Article 20).
Furthermore, we expressly draw your attention to the fact that you have the right to withdraw your consent to the processing of data at any time (without prejudice to the lawfulness of the processing based on consent carried out prior to the withdrawal of consent).
The processing of your data does not involve automated decision-making which has legal effects for you or significantly affects you in a similar way, nor does it include profiling.
How can I exercise my rights?
Any communication relating to a request for information, a complaint, the exercise of your rights under the provisions of Regulation (EU) 2016/679 or the withdrawal of your consent to the processing of your data, should be addressed to the Data Protection Officer of the Ministry by sending an e-mail to the address dpo@digital.etat.lu or by post (4, rue de la Congrégation; L-1352 Luxembourg).
Right to lodge a complaint with the supervisory authority
If, after having contacted us, you believe that the processing of your data by the Ministry constitutes an infringement of Regulation (EU) 2016/679 or that your rights under that regulation are not being respected, you may lodge a complaint with the National Commission for Data Protection (15, Boulevard du Jazz; L-4370 Belvaux; https://cnpd.public.lu).
